Terms for using Crumblinks

These Terms of Service govern access to and use of the Crumblinks website, dashboard, tracking tools, integrations, APIs, SDKs, and related services.

Legal review notice: These are general terms prepared for Crumblinks and should be reviewed by qualified legal counsel for the jurisdictions, commercial arrangements, and data practices that apply to the service.

1. Acceptance of These Terms

By accessing or using Crumblinks, you agree to these Terms of Service and any policies referenced in them. If you use Crumblinks on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.

If you do not agree to these terms, do not access or use the service.

2. Service Description

Crumblinks provides software for campaign links, traffic and event tracking, attribution reporting, conversion workflows, dashboards, integrations, and related analytics operations. Features may include browser or server-side event collection, SDKs, APIs, postbacks, and connections to advertising, game, commerce, community, or other platforms.

The service may evolve over time. We may add, modify, suspend, or discontinue features when reasonably necessary to operate, secure, or improve Crumblinks.

3. Accounts and Access

You must provide accurate account information and keep it current. You are responsible for safeguarding login credentials, API keys, integration credentials, and other access methods associated with your account.

You are responsible for activity under your account and for ensuring that authorized users comply with these terms. Notify us promptly if you become aware of unauthorized access, compromised credentials, or another security issue affecting your account.

You may use Crumblinks only in compliance with applicable law, these terms, and the rights of others. You must not:

5. Attribution and Tracking Data

You control the campaigns, links, trackers, events, identifiers, destinations, and integrations configured in your workspace. You are responsible for the lawfulness, accuracy, and appropriateness of data submitted to Crumblinks and for providing notices and obtaining choices or consents required for your websites, games, applications, stores, communities, and campaigns.

You should not submit sensitive personal information, credentials, payment card data, or other regulated data unless its processing is expressly supported by Crumblinks and covered by an appropriate written agreement.

Attribution and reporting outputs depend on customer configuration, source data, platform behavior, browser settings, technical availability, and other factors. You are responsible for validating configurations and outputs before relying on them for business, advertising, financial, or compliance decisions.

6. Third-Party Platforms and Ad Networks

Crumblinks may connect with third-party advertising networks, analytics services, game platforms, community services, stores, APIs, or other products. Your use of a third-party service remains governed by that provider's terms and policies.

We do not control third-party systems and are not responsible for their availability, data, decisions, policy changes, account restrictions, or other acts or omissions. You are responsible for maintaining permission to connect each third-party account and for configuring integrations in accordance with the provider's requirements.

7. Billing and Subscriptions

Some Crumblinks features may require a paid subscription, usage-based fees, or another commercial arrangement. Applicable fees, billing periods, usage limits, taxes, renewal terms, and cancellation rules will be presented in the service, an order form, or another written agreement.

You authorize applicable charges using the payment method associated with your account. Except where required by law or stated in a written agreement, paid fees are non-refundable. Overdue amounts may result in restricted or suspended access after reasonable notice.

8. Intellectual Property

Crumblinks and its licensors retain all rights in the service, software, documentation, designs, trademarks, and related materials. Subject to these terms and any applicable written agreement, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business purposes.

You retain rights in data and content you submit to the service. You grant Crumblinks the rights reasonably necessary to host, process, transmit, secure, and display that data to provide and support the service. If you provide feedback, you permit us to use it without restriction or obligation.

9. Privacy

Our Privacy Policy explains how Crumblinks handles personal data in connection with the website and service. Customers may also have separate obligations as controllers or businesses responsible for their own end users and tracked properties.

10. Disclaimers

To the maximum extent permitted by law, Crumblinks is provided "as is" and "as available." We disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will always be uninterrupted, error-free, secure, or compatible with every third-party platform, or that reports and outputs will be complete or suitable for every purpose. Nothing in these terms excludes warranties or rights that cannot lawfully be excluded.

11. Limitation of Liability

To the maximum extent permitted by law, Crumblinks and its affiliates, officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from or related to the service.

To the maximum extent permitted by law, the total aggregate liability arising from or related to the service will not exceed the amounts paid by you to Crumblinks for the service during the twelve months before the event giving rise to the claim. These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose.

12. Suspension and Termination

You may stop using the service at any time and may cancel a subscription according to the applicable billing or written terms. We may suspend or terminate access if you materially breach these terms, create security or legal risk, fail to pay applicable fees, or use the service in a way that may harm Crumblinks, its users, or third parties.

Where reasonably practicable, we will provide notice and an opportunity to address the issue. Provisions that by their nature should survive termination, including provisions concerning ownership, disclaimers, liability, and accrued payment obligations, will survive.

13. Changes to These Terms

We may update these terms from time to time. We will update the date above and may provide additional notice for material changes where appropriate. Continued use of the service after updated terms take effect constitutes acceptance of the updated terms to the extent permitted by law.

14. General Terms

These terms, together with referenced policies and any applicable order form or written agreement, form the agreement between you and Crumblinks concerning the service. If a written agreement expressly conflicts with these terms, the written agreement controls for that conflict.

You may not assign your rights or obligations under these terms without our consent, except as part of a merger, acquisition, corporate reorganization, or sale of substantially all relevant assets. We may assign these terms as part of a business transaction or corporate reorganization. If any provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.
